1. Acceptance of Terms

By accessing and using MediWatchers, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

MediWatchers is a healthcare management platform that provides medication tracking, reminder notifications, appointment scheduling, and related healthcare management tools. This service is not a substitute for professional medical advice, diagnosis, or treatment.

3. Account Registration & Third-Party Authentication

You may create a MediWatchers account using your email address and password, or by signing in through a supported third-party authentication service ("Social Login"), including Facebook, Google, GitHub, Apple, and LinkedIn.

When using Social Login:

• You authorize MediWatchers to access your basic profile information (name and email address) from the Social Login Provider for account creation and authentication purposes.
• You are responsible for maintaining the security of your third-party account. MediWatchers is not liable for any unauthorized access resulting from a compromise of your Social Login Provider credentials.
• You may link your Social Login credentials to an existing MediWatchers account or create a new account using your social profile information.
• Revoking MediWatchers' access through your Social Login Provider's settings will prevent future social logins but will not delete your MediWatchers account. You may still access your account using email and password if configured.
• MediWatchers does not control the availability of third-party authentication services. If a Social Login Provider becomes unavailable, you may still access your account using email and password if configured, or by contacting support.

4. User Responsibilities

You are responsible for:

• Providing accurate and current information
• Maintaining the confidentiality of your account credentials, including any linked social login accounts
• All activities that occur under your account, regardless of sign-in method used
• Consulting with healthcare professionals regarding your medical care

5. Medical Disclaimer

MediWatchers is not a medical device and should not be used as a substitute for professional medical advice. Always consult with qualified healthcare providers regarding your medical care and never disregard professional medical advice based on information from our platform.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices, including how we handle data received from Social Login Providers.

7. Prohibited Uses

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To create multiple accounts using different Social Login Providers to circumvent restrictions or abuse the platform

8. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All new paid plans include a 14-day free trial. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

9. Account Termination

You may request deletion of your account at any time by contacting us. Upon termination, all personal data associated with your account, including linked Social Login credentials, will be permanently removed within 30 days. MediWatchers reserves the right to terminate accounts that violate these terms.

10. Limitation of Liability

In no event shall MediWatchers, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Dispute Resolution

Informal Resolution. Before filing any formal dispute, you agree to first contact MediWatchers at legal@mediwatchers.com to attempt to resolve the matter informally. We will make a good-faith effort to resolve any dispute within 30 days of receiving your written notice. Most concerns can be resolved quickly through direct communication.

Billing Disputes. If you believe you have been incorrectly charged, you must contact us within 60 days of the charge in question. We will review your claim and, if appropriate, issue a refund or credit to your account. Refund requests for subscription fees will be evaluated on a case-by-case basis, taking into account usage, timing of the request, and the nature of the dispute.

Binding Arbitration. If a dispute cannot be resolved informally, you and MediWatchers agree to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis, in English, and will take place in the state of your primary residence or remotely via video conference, at your election. The arbitrator's decision will be final and binding, and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entire arbitration provision shall be void.

Exceptions. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Small claims court actions that qualify may also be brought in the appropriate court instead of arbitration.

Governing Law. These Terms and any disputes arising from your use of MediWatchers shall be governed by and construed in accordance with the laws of the United States and the State in which MediWatchers is incorporated, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.
